Terms of Use

1. Agreement

These Terms of Use constitute a legally binding agreement between you and Beyondend Dev ("we," "us," or "our"), a company registered in Turkey at Zühtüpaşa, Rıfat Bey Sk. No:2 kat:3, 34724 Kadıköy/İstanbul, regarding your use of the WhatsAppDrive AI service ("the Service"). By subscribing to or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. The Service

WhatsAppDrive AI is a WhatsApp-native archiving assistant. After you subscribe, you bind your license to a direct WhatsApp chat or WhatsApp group with wdclaim, connect a Google Drive account with wdconnect, and reply to files in that chat with wdload. An AI proposes a folder path and a file name based on your accompanying note and the file's metadata, and the file is uploaded directly into your Drive. Additional commands (wdroot, wdsysprompt, wdsyspromptup) let you customise the destination folder and archiving instructions.

3. Subscription and Billing

The Service is provided on a recurring subscription basis. Subscriptions, payments, invoices, taxes, refunds, and the customer portal are handled by our payment partner Polar, which acts as Merchant of Record. By subscribing you accept Polar's own terms in addition to these Terms. We never see or store your card details.

4. License Scope

Each active subscription provides one license key that can be bound to one WhatsApp chat at a time, whether that is a direct chat or a group. You may move a license to another chat by sending wdclaim unlink in the current chat and a fresh wdclaim in the new one. Your Google Drive connection is associated with the license itself, so it moves with the license when you change chats.

5. No Refunds, Cancellation, and Service Risks

All sales are final. By subscribing you acknowledge that you have read and understood this section and that you accept the risks described below. We do not issue refunds or partial refunds, for any reason, including but not limited to:

• Service outages, maintenance, or downtime, whether planned or unplanned.
• Rate-limit rejections, quota exhaustion, or temporary throttling.
• Outages, policy changes, or breaking changes on the part of WhatsApp (Meta), Google Drive (Google), our AI provider (Groq), or our payment partner (Polar).
• Suspension or banning of the shared WhatsApp number we operate, which would interrupt or end the Service for all subscribers until restored.
• Loss of access to your Google Drive account, revocation of OAuth permissions, or storage-quota exhaustion on your side.
• AI output quality issues — for example, folder paths or file names you find imperfect, inconsistent, or wrong.
• Mis-classification, overwrite, duplication, or any other unintended outcome of an upload.
• Subjective dissatisfaction with the Service, change of mind, or accidental subscription.
• Security incidents, attacks, or abuse by third parties affecting the Service.
• Compliance, regulatory, or legal changes that require us to modify, restrict, or discontinue the Service.

You may cancel your subscription at any time from the Polar customer portal. Cancellation stops future billing but does not entitle you to a refund of the current or any previous billing period. After cancellation, you keep access until the end of the current period; once that period ends, the license is revoked by Polar and uploads stop working. You can resubscribe later, but a new license key will be issued.

If you are not prepared to accept these risks, please do not subscribe.

6. Your Google Drive

The Service operates against the Google Drive account you authorise via OAuth. You are responsible for that account, its storage quota, its sharing settings, and the contents of the destination folder. We have no ability to recover files from your Drive on your behalf and no responsibility for files you delete, overwrite, or move within Drive.

7. Acceptable Use

You agree to use the Service only for lawful purposes and only to archive files that you have the right to store. You must not use the Service to transmit, store, or process illegal content, malware, copyright-infringing material, or content that violates the terms of WhatsApp, Google Drive, Polar, or our AI provider. You are solely responsible for the content you forward through the Service.

8. Custom Archiving Instructions

You may set custom archiving instructions with wdsyspromptup. A safety filter rejects attempts to override the system's fixed rules, request unreasonable folder depths, change the file-naming contract, or otherwise abuse the AI. We reserve the right to reject, revert, or further filter instructions that compromise the Service for you or for other subscribers.

9. Rate Limits and Fair Use

The Service enforces per-chat rate limits to prevent abuse and to stay within the quotas of our AI provider. Sustained bursts may be temporarily rejected with a retry-after message. We may adjust these limits to keep the Service stable for all subscribers.

10. Third-Party Dependencies

The Service depends on WhatsApp (Meta), Google Drive (Google), our AI provider (Groq), and our payment partner (Polar). Outages, policy changes, or rate-limit changes at any of these providers may affect the Service. We will make reasonable efforts to adapt, but we are not responsible for the availability of these third parties.

11. Intellectual Property

The Service, its workflows, design, code, name, and associated materials are the intellectual property of Beyondend Dev, protected under applicable copyright and trademark law. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Service without our express written permission. Files you upload through the Service remain yours.

12. No Warranties

The Service is provided "as is" without warranty of any kind, express or implied. We make no guarantees regarding the Service's availability, reliability, accuracy, or fitness for any particular purpose, including the accuracy of AI-proposed folder paths and file names. Use of the Service is at your own risk.

13. Limitation of Liability

To the fullest extent permitted by law, Beyondend Dev shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including any loss, mis-classification, overwrite, or duplication of files in your Drive. You are solely responsible for the contents of your own Drive and for maintaining backups of important data.

14. Modifications

We reserve the right to update or modify these Terms at any time. The updated Terms will be posted on this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Turkey.
